AI Compliance for Insurance Companies
Meet EU AI Act, NAIC, and DORA obligations for AI in underwriting, pricing, and claims.
Insurance companies use AI in underwriting, claims processing, fraud detection, pricing, and customer service. These use cases face overlapping AI compliance obligations: EU AI Act Annex III classification, NAIC Model Bulletin on AI use, DORA (for EU insurers), state insurance department AI guidance, and ECOA/Fair Housing requirements. Aegis Firma helps insurance teams manage all of these without a dedicated AI compliance team.
AI Compliance Challenges for Insurance
Regulations That Apply to Insurance
EU AI Act — High Risk Life/Health Insurance
AI systems used for life and health insurance risk assessment and pricing are classified high-risk under EU AI Act Annex III §5(c). General property & casualty underwriting and claims-processing AI are not automatically covered by Annex III point 5 — assess case-by-case against the other high-risk categories. Technical documentation, human oversight, and post-market monitoring required where high-risk applies.
NAIC Model Bulletin on AI
NAIC has issued model guidelines requiring insurers to document AI systems, assess for unfair discrimination, maintain human oversight, and ensure AI decisions comply with applicable insurance laws.
DORA (EU)
Digital Operational Resilience Act applies to EU financial entities including insurers — AI systems and third-party AI vendors must be managed under DORA ICT risk management requirements.
State Insurance Department AI Guidance
Colorado, Illinois, California, and other states have insurance-specific AI guidance covering algorithmic underwriting, rating, and claims AI fairness requirements.

Frequently Asked Questions
Does EU AI Act Annex III cover our pricing algorithm?
If your AI system determines life or health insurance premiums or risk-assessment scoring (Annex III §5(c)), or evaluates creditworthiness for insurance purposes (Annex III §5(b)), it is classified high-risk under the EU AI Act. General P&C/auto underwriting AI is not automatically covered by Annex III point 5 itself. High-risk obligations include technical documentation, bias assessment, human oversight, and registration in the EU AI database.
What does the NAIC Model Bulletin require?
The NAIC Model Bulletin requires insurers to: document all AI systems used in insurance decisions; assess for unfair discrimination; maintain human oversight and accountability; ensure AI decisions comply with applicable state insurance laws; and be able to explain AI-driven decisions to regulators and consumers.
