AI Compliance for Healthcare: The Complete Guide

Healthcare AI faces the strictest compliance requirements of any industry. The EU AI Act classifies most diagnostic AI as high-risk. In the US, the FDA regulates software as a medical device. HIPAA adds privacy requirements. Here is what all of it means in practice.

Why healthcare AI faces the most regulatory scrutiny

Healthcare AI makes decisions that can kill people. A diagnostic AI that misses a tumor, a drug interaction checker that misses a contraindication, or a triage algorithm that deprioritizes the wrong patient — the consequences of errors are immediate and severe. Regulators designed their frameworks with this in mind.

The EU AI Act classifies AI systems in all of the following as high-risk: diagnosis, treatment, patient monitoring, prediction, and management of medical conditions. If your AI system touches any clinical decision, it is high-risk under EU law.

EU AI Act requirements for healthcare AI

Most clinical/diagnostic AI is classified high-risk not through Annex III but through the separate Article 6(1) + Annex I route: an AI system that is a safety component of (or is itself) a product already covered by EU product-safety legislation — the Medical Device Regulation (MDR) and In Vitro Diagnostic Regulation (IVDR) are both listed in Annex I — and that requires third-party conformity assessment under that legislation is automatically high-risk under the AI Act. (A narrower set of healthcare uses — e.g. emergency-triage AI — can separately fall under Annex III's "essential services" category, but general diagnostic/treatment AI reaches high-risk status via the Annex I/MDR route.)

For AI systems used in clinical settings, the EU AI Act requirements are extensive:

Risk management system (Article 9)

You must maintain an ongoing risk management process throughout the lifecycle of the AI system. This means identifying risks at design time, testing them before deployment, monitoring them in production, and updating your risk documentation when the system or its context changes.

Training data governance (Article 10)

Training data must be relevant, representative, error-free, and complete to the extent possible. For medical AI, this means your training dataset must accurately represent the patient population the AI will be used on — including diverse demographics, conditions, and edge cases. A model trained on predominantly male patients is not representative for female patients. This must be documented.

Technical documentation (Article 11)

Extensive documentation covering: general description and intended purpose, design specifications, architecture, training data description, validation results, accuracy metrics, known limitations, instructions for deployment, and post-market monitoring plan.

Logging (Article 12)

High-risk AI systems must automatically log events "sufficient to ensure that it is possible to assess compliance with the requirements... throughout the system's lifetime." For healthcare AI, this typically means logging each inference, the input data used, the output, the time, and the clinical context.

Human oversight (Article 14)

Perhaps the most impactful for clinical workflows: high-risk AI must be designed so that natural persons can "fully understand the capacities and limitations of the high-risk AI system and be able to duly monitor its operation." Clinicians must be able to override the AI, and the system must not present its output in a way that discourages clinical judgment. A diagnostic AI that presents a "definitive diagnosis" without confidence intervals or uncertainty estimates is not compliant.

Accuracy and robustness (Article 15)

The AI must be accurate, robust, and cybersecure. For medical AI, accuracy metrics must be validated on diverse datasets, and performance degradation over time must be monitored.

EU Medical Device Regulation (MDR) interaction

In the EU, AI software used in clinical decision support may qualify as a "software as medical device" (SaMD) under the EU MDR (Regulation 2017/745). If it does, you face MDR compliance in addition to the EU AI Act.

The EU AI Act and MDR are designed to work together. Article 43(3) of the EU AI Act allows AI systems already undergoing MDR notified-body conformity assessment to have the AI Act's requirements folded into that same procedure — one combined technical file and quality management system, rather than two separate certification tracks. This is an integration mechanism, not a blanket presumption of conformity — you still need to verify your specific MDR assessment actually covers every AI Act requirement.

US FDA Software as Medical Device (SaMD)

In the US, the FDA regulates "Software as a Medical Device" — software intended for one or more medical purposes that performs these purposes without being part of a hardware medical device. This includes AI diagnostic tools, clinical decision support software, and medical imaging AI.

FDA classification determines the regulatory pathway:

The FDA's "Clinical Decision Support" guidance distinguishes between non-device CDS software (no FDA oversight) and device CDS software (FDA oversight). The key factor: does the software provide recommendations that a clinician cannot independently verify without understanding the underlying basis? If the AI black-boxes its reasoning to the point where a clinician cannot check it — it is likely a device.

HIPAA requirements for healthcare AI

HIPAA applies to covered entities (healthcare providers, health plans, clearinghouses) and their business associates. If you provide healthcare AI to these organizations and access protected health information (PHI), you are likely a business associate.

Key HIPAA requirements for healthcare AI developers:

HIPAA does not currently have AI-specific provisions. Watch for HHS guidance on AI and PHI — the Office for Civil Rights has indicated this is a priority area.

Practical compliance roadmap for healthcare AI companies

If you are building (provider/developer)

  1. Determine FDA classification for your product — engage FDA early via pre-submission meeting if you are unsure
  2. Start EU AI Act technical documentation immediately — this takes 3–6 months for a mature healthcare AI product
  3. Implement comprehensive logging from day one — retrofitting is painful
  4. Design human oversight into the UX — the AI should present confidence levels, not certainties
  5. Ensure training data is diverse and representative — document this explicitly
  6. Sign BAAs with any healthcare organization that tests or deploys your product

If you are deploying (healthcare provider using AI tools)

  1. Get the AI Act conformity documentation from your vendor — they must provide this
  2. Ensure your vendor has signed a BAA if they handle PHI
  3. Train clinical staff on AI limitations and the human oversight requirements
  4. Document your own risk assessment of the AI tool in your clinical context
  5. Establish a monitoring process for AI performance drift
